Sidney Powell plans to appeal the dismissal of the Georgia lawsuit issued earlier today, with the goal of getting the case to the U.S. Supreme Court.

A federal judge dismissed former Trump attorney Sidney Powell’s lawsuit alleging widespread voter fraud in Georgia Monday, marking the second loss in Powell’s nationwide legal effort alleging voter fraud through Dominion voting machines and yet another blow to the Trump campaign and GOP’s campaign to overturn President-elect Joe Biden’s victory.

The ruling in Georgia came less than 90 minutes into a hearing in Atlanta federal court, where Powell had claimed that Trump was the victim of massive ballot fraud related to Georgia's use of Dominion voting machines.

Judge Timothy Batten Sr. said this when dismissing the case:

“The relief that the plaintiffs seek this court cannot grant.”

“They ask the court to order the secretary of state to decertify the election results as if such a mechanism even exists, and I find that it does not.”

Batten repeatedly suggested that Powell could have filed her lawsuit in state court, and he cited an federal appeals court ruling that “federal courts don’t entertain post-election conduct, excuse me, contests about vote-counting misconduct.”

Batten did not rule on the merits of Powell’s claim, which were made on behalf of a slate of would-be Trump electors in the Electoral College.

This is the second case in one day to be thrown out. A federal judge in Michigan denied Sidney Powell’s request to decertify the state’s election result and slammed her claims of a vast election-fraud conspiracy as an assault on hard-fought voting rights, saying the “people have spoken.”

The suit against Michigan Governor Gretchen Whitmer and Secretary of State Jocelyn Benson is one of those Powell, filed last month on behalf of Republican voters.

“Plaintiffs ask this court to ignore the orderly statutory scheme established to challenge elections and to ignore the will of millions of voters,” U.S. District Judge Linda V. Parker said in a ruling Monday denying Powell’s emergency motion to block election certification and force inspections of voting machines, software and security footage of polling places. “This, the court cannot, and will not, do.”

“The closest plaintiffs get to alleging that election machines and software changed votes for President Trump to Vice President Biden in Wayne County is an amalgamation of theories, conjecture, and speculation that such alterations were possible,” Parker, an appointee of former President Barack Obama, wrote in her decision.

“This lawsuit seems to be less about achieving the relief plaintiffs seek—as much of that relief is beyond the power of this court—and more about the impact of their allegations on people’s faith in the democratic process and their trust in our government.”

Sydney Powell on Mornings with Maria:

We’re fixin’ to overturn the results of the election in multiple states, and President Trump won by not just hundreds of thousands of votes but by millions of votes that were shifted by this software that was designed expressly for that purpose.  We have sworn witness testimony of why the software was designed.  It was designed to rig elections.  He was fully briefed on it.  He saw it happen in other countries.  It was exported internationally for profit by the people that are behind Smartmatic and Dominion.

They did this on purpose.  It was calculated and they’ve done it before.  We have evidence from 2016 in California.  We have so much evidence I feel like it’s coming in through a fire hose.”

Sidney Powell on Lou Dobbs this week, threatened to release the ‘Release the Kraken’! Stating that there was massive fraud in the 2020 US election. This morning Sidney Powell and Rudy Giuliani did just that on Sunday Morning Futures with Marie Bartiromo.

Former Gen. Michael Flynn Sidney Powell: “We’re getting ready to overturn election results in multiple states,” Powell said, saying that she has enough evidence of election fraud to launch a widespread criminal investigation.

“I don’t make comments without having the evidence to back it up,” she added, saying that elections software switched “millions of votes” from Trump to Democratic nominee Joe Biden.

“We have so much evidence, I feel like it’s coming in through a fire hose,” Powell said, while noting that she won’t reveal the evidence that she has.

“They can stick a thumb drive in the [voting] machine, they can upload software to it even from the Internet … from Germany or Venezuela even,” she said, adding that operations “can watch votes in real-time” and “can shift votes in real-time,” or alleged bad actors can “remote access anything.”

“We’ve identified mathematically the exact algorithm they’ve used—and planned to use from the beginning” that allegedly switched votes to Biden, Powell remarked.

“(W)e have concerns about the spread and effect of private equity investment in many sectors of the economy, including the election technology industry—an integral part of our nation’s democratic process,” wrote the lawmakers in their letters to the firms about a year ago.

“These problems threaten the integrity of our elections and demonstrate the importance of election systems that are strong, durable, and not vulnerable to attack.”

Earlier on Monday, President Donald Trump claimed he had "won the 2020 election", also publishing a series of tweets, in which he lambasted "radical left-owned Dominion voting systems". Although the official tally from the election is yet to be announced and certified, Joe Biden and the main-stream media have declared himself US president-elect.

While President Trump is contesting the results of the Election, Twitter is only tagging the presidents claims as disputed and ignoring inaccuracies published in the main-stream media.

The US president's attorney, Sidney Powell, has called for CIA Director Gina Haspel to be fired for disregarding warnings about voting software that Powell claimed was "designed to rig" the 3 November election.

"Why Gina Haspel is still there in the CIA is beyond my comprehension. She should be fired immediately", Powell told Fox News on Sunday, pointing to alleged problems with Dominion Voting Systems' software used in several of the key battleground states during Election Day.

She referred to an array of "whistleblowers" who she said may confirm that the Dominion software was ostensibly used to scrap "millions" of votes cast in favor of Trump.

When asked about evidence, Powell claimed that she had "lots of ways to prove it", but that she was "not gonna tell on national TV what all we have".

Her remarks echoed those made by President Donald Trump in his latest series of tweets, in which he specifically criticised what he described as "radical left-owned Dominion Voting Systems", also insisting that the US "cannot allow the fake results of the 2020 mail-in election to stand".

This followed the president tweeting that Joe Biden won "because the election was rigged", adding in a follow-up post that he "concedes nothing", as the Democratic contender only won "in the eyes of [the] fake news media".

Dominion, in turn, claimed in a statement published on its website that it "categorically denies false assertions about vote switching issues with our voting system".

The Department of Homeland Security's Cybersecurity and Infrastructure Security Agency seemed to strike the same tone, insisting "there is no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised".

The statement came after Trump campaign attorney Jay Sekulow demanded recounts in every state using the Dominion software that he claimed wrongly gave 6,000 votes to Democrats in one Michigan county during the election.

"If 30 states have used the software that there's already proved to be a glitch of 6,000 votes in one balloting area [...] lawyers should be... demanding a manual recount. Post-election litigation is important to protect the integrity of the election process, as the president said, and to protect the constitution frankly", Sekulow asserted.

Trump has repeatedly accused the Dominion Voting Systems Corporation of being responsible for its vote-tallying machine software erroneously "flipping" votes to Democrats.

POTUS also suggested that the "glitches" in voting machines reported at some polling stations on Election Day was evidence of the Democrats trying to "steal" votes from him during vote counting in key states.

The president declines to concede the election to Biden, who earlier proclaimed himself president-elect and is currently involved in forming his transition team, despite the official tally not having been announced yet.

Breitbart summarizes the key allegations as follows:

    1. Observers were allegedly prevented from watching mail-in ballots being opened. Giuliani said that many mail-in ballots were opened without observers being able to check that they were properly signed, a key protection against fraud. Those votes, he said, were “null and void,” especially where the envelopes had been discarded, making recounts useless.

    2. Allegedly unequal application of the law in Democratic counties. In Pennsylvania, whose state supreme court created new, relaxed voting rules before the election, Giuliani alleged that absentee voters in Democratic counties were allowed to “cure” defects in their ballots, while voters in Republican counties, which obeyed the state law as written, were not.

    3. Voters allegedly arrived at the polls to discover other people had voted for them. Giuliani said that many provisional ballots cast in Pittsburgh were submitted by people who showed up to vote in person, only to be told that they had voted already. He alleged that Democrats had filled out absentee ballots for other people, hoping they would not show up.

    4. Election officials were allegedly told not to look for defects in ballots, and to backdate ballots. Giuliani cited an affidavit from an official who swore she was told not to exclude absentee ballots for defects, and to backdate ballots so they would not appear to have been received after Election Day, to avoid a Supreme Court order to sequester those ballots.

    5. Ballots casting votes for Joe Biden and no other candidates were allegedly run several times through machines. Giuliani said that there were 60 witnesses in Michigan who would attest to ballots being “produced” quickly and counted twice or thrice. He said that a minimum of 60,000 ballots, and a maximum of 100,000 ballots, were allegedly affected.

    6. Absentee ballots were accepted in Wisconsin without being applied for first. Giuliani noted that Wisconsin state law was stricter regarding absentee ballots than most other states are, yet alleged that 60,000 absentee ballots were counted in the Milwaukee area, and 40,000 in the Madison area, without having been applied for properly by the voters who cast them.

    7. There were allegedly “overvotes,” with some precincts allegedly recording more voters than residents, among other problems. Giuliani said there was an unusually large number of overvotes in precincts in Michigan and in Wisconsin, which he alleged was the reason that Republicans on the Wayne County Board of Canvassers had refused to certify the results there this week. He also alleged that there were some out-of-state voters in Georgia, and people who had cast votes twice there.

    8. Voting machines and software are allegedly owned by companies with ties to the Venezuelan regime and to left-wing donor George Soros. Sidney Powell argued that U.S. votes were being counted overseas, and that Dominion voting machines and Smartmatic software were controlled by foreign interests, manipulating algorithms to change the results. Powell noted specifically that Smartmatic’s owners included two Venezuelan nationals, whom she alleged had ties to the regime of Hugo Chavez and Nicolas Maduro. The legal team alleged that there were statistical anomalies, such as huge batches of votes for Biden, that could not be explained except as manipulation — which, they alleged, happened in the wee hours of the morning as vote-counting had stalled. (The companies have disputed these allegations vigorously.)

    9. The Constitution provides a process for electing a president if the vote is corrupted. Jenna Ellis argued that the media, had usurped the power to declare the winner of the election. She made the point, citing Federalist No. 68, that the constitutional process of selecting a president had procedural safeguards against corruption and foreign influence.
Giuliani said that the campaign believed that enough votes were flawed — more than double the margins between Biden and Trump in key states — that the president had a path to victory.

"We will not be intimidated...We are going to clean this mess up now. President Trump won by a landslide. We are going to prove it. And we are going to reclaim the United States of America for the people who vote for freedom."—Sidney Powell
